| The Nay/McNee Clan Webmaster (hereinafter referred to as the Webmaster)
provides computing and information services (the "services") to those persons
("Users") who utilize its service. By using the service, each User agrees to be bound by all of
the terms of service set forth in the following paragraphs.
The Webmaster reserves the right in his sole discretion to deny access or service to any User.
By providing information to the Webmaster, each User hereby grants permission for the Webmaster to use
such information for the purpose of providing services unless a restriction on such use is transmitted to
the Webmaster by e-mail prior to such use. This information will only be used as needed to provide the
services requested by the User. (See the Webmaster's Privacy Policy.)
Each User hereby indemnifies the Webmaster against any liability relating to the Webmaster's use of
information provided by such User or relating to such User's violation of these terms of service.
The Webmaster undertakes no responsibility to review the contents of any information provided to Users,
including but not limited to information accessed through links to other sites and forwarded email, and by
using the service each User agrees that the Webmaster shall have no liability for such contents. (See the

The Webmaster or his agents may, at their sole discretion may add or remove domains on the list of
domains available for email and website services.
No email address from a domain owned by the Webmaster may be utilized as return addresses or for
websites for bulk commercial email solicitations, bulk advertising, offensive or illegal communications,
communications which infringe intellectual property rights, or communications which harass, intimidate or
otherwise violate the rights of others. No website URL from a domain owned by the Webmaster may be
utilized for anything offensive or illegal, anything which infringes on intellectual property rights,
gambling, the abuse or misuse of alcohol, tobacco and drugs, or anything which harasses, intimidates or
otherwise violates the rights of others. The Webmaster reserves the right to terminate the registration of
any person who violates this policy.
Each User expressly agrees that use of the services provided by the Webmaster is at the
User's sole risk. Neither the Webmaster nor any of his employees or agents warrant that the service will
be uninterrupted or error free; nor does the Webmaster or any of his employees or agents make any warrant
as to the results obtained from use of the services. The service is distributes on an "as is"
basis without warranties of any kind, either express or implied, including but not limited to warranties
of title or implied warranties of merchantability or fitness for a particular purpose or otherwise.
Neither the Webmaster nor any one else involved in creating, producing, or delivering the service shall be
liable for any direct, indirect, incidental, special, or consequential damages arising out of use of the
service or inability to use the service or out of any breach of any warranty.
The term Webmaster
as used herein shall also pertain to any employees, agents, assigns, or successors of the Webmaster.
These terms of service may be modified by the Webmaster at any time by publication on the
website.

Virus
Warning: You may have noticed an increase in virus-infected emails coming into your inbox, a good
number of them purportedly from people or organizations you know and trust. In many cases, the infected
emails are not from the reported senders. I have received infected files allegedly from friends,
coworkers, relatives and even my own closed e-mail accounts which I haven't used for months! Some people
have reported receiving them from my accounts, only one of which I use regularly. Information on the most
common virus of this type is available from the McAfee Virus Information Library at http://vil.mcafee.com/dispVirus.asp?virus_k=99455.
Note that this virus has the ability to spoof the e-mail header, and make it appear that the message was
sent by someone in the victim's own address book. That means an infected email that appears to come from a
coworker could have come from anyone who has that coworker's email address in their address book, as well
as from the coworker's own computer (if infected). Here is how to deal with computer viruses (these steps
have kept my computer virus-clean since 1985):
- Ensure you
have an active "auto-protect" virus scanner constantly running on your computer. This should
alert you of a problem as soon as detected and before any damage is done.
- In addition
to the above, regularly scan your computer with the latest virus definition profiles for your anti-virus
program (I do this weekly). McAfee, Symantec/Norton, F-Prot, PC-Cillin, and others all have the ability to
reliably detect and eliminate known viruses.
- Update your
virus definition files often (checking twice a week is not too often these days). I have my anti-virus
software set to automatically download the latest virus definition file as soon as it's released.
- If you
receive an infected email attachment or an unexpected email attachment from someone you do not know,
delete it without opening it.
- Ignore email
virus warnings from well-meaning coworkers, friends, and relatives. Never forward these messages. Some of
them are bogus. Others actually contain virus attachments. Many even contain dangerous instructions such
as to delete essential system files from your computer!
- Refer to the
IBM
Virus Hoax Page, McAffee Virus Hoax Page, Stiller
Virus Hoax Page, or the Symantic
Virus Hoax Page if you receive emails about viruses.
- Subscribe to
a free virus newsletter from publishers such as www.mcaffee.com,
or www.norton.com.
- This is one
time when paranoia is healthy. Just because you're paranoid doesn't mean they're not out to get you!
Pornography
Warning: Many of my web pages include links to other web sites that are maintained by other
persons. I personally check all web sites before I link to them to ensure they are worthwhile and safe for
trusting minds. However, it is not unusual for an innocent web site to turn into one you don't want your
family to visit. What happened? It's a practice called called porn-napping. If a site's domain registry
expires, the name is available for anyone to purchase and use. Sometimes, very worthwhile web sites simply
disappear -- along with the content you're seeking. Even worse, the bad guys buy many of these expired
domain names that have earned a good reputation and use them to assault us with pornography, internet
gambling, scams, etc. The porn site often holds the URL's good name hostage, offering to sell the address

Genealogical information which is shared with the Webmaster may be published on this website.
Nevertheless, the Webmaster will not publish personal information such as ages, dates, and places of
persons known to the Webmaster to be living. Otherwise, the Webmaster will send personally identifiable
information about you to other companies or people only when:
- We have your consent to share the information;
- We need to share your information to provide the product or service you have requested;
- We need to send the information to companies who work on behalf of the Webmaster to provide a

family history posted on our website, service usage tips, information about new or upgraded services that
